Terms of Use



  1. GENERAL

  2. In consideration for the City of North Vancouver (the “City”) granting access to the CityServe website and the services provided through CityServe, the person accessing CityServe (the “User”) must agree to and accept these Terms of Use (the “Terms”).

    The City may change the Terms at any time without notice. Users should review the Terms posted on the CityServe website periodically. Users may be requested to agree to separate terms of use for other services (web-based or otherwise) offered by the City.

     

  3. INFORMATION ON THE SITE

  4. The City provides CityServe as a service for applying for a permit or licence. The City makes no representation or warranty expressed or implied with respect to the accuracy, completeness or currency of information on CityServe, nor of its appropriateness for a particular use.

     

  5. AVAILABILITY OF CITYSERVE

  6. The User accepts that the availability of and access to CityServe is not guaranteed. Computer applications, servers and network connections associated with CityServe may be unavailable at any time for maintenance or unscheduled outages. The User acknowledges that it is not entitled to depend on access to CityServe.

     

  7. CODE OF CONDUCT


  8. Users of CityServe agree to the following code of conduct:

    1. To apply or track a permit, licence, or application using CityServe, the User must first create a CityServe account;
    2. The information the User provides on CityServe must be truthful, accurate and up to date. The User will not provide misleading information or make misrepresentations. Any permit or licence issued based on incorrect, inaccurate, or misleading information or a misrepresentation is void;
    3. The User will only use their CityServe account to apply for permits, licences, or applications to be issued in the User’s name;
    4. The User will not upload any files onto CityServe that are unlawful, harmful, threatening, vulgar, obscene, libellous or otherwise objectionable;
    5. The User will not do any act that undermines, or could undermine, the security of CityServe including but not limited to hacking, cracking, mail bombing, mounting a denial of service attack, or any other malicious, careless or negligent act;
    6. The User will not re-sell, sublicense, or operate a service using CityServe, or otherwise reproduce, publish or disseminate CityServe for commercial purposes, without the prior written consent of the City;
    7. The User will comply with all bylaws of the City and other applicable statutes and regulations in respect of which an application is made; and
    8. The User will not use any of the City’s logos without the written authorization from the City.

     

  9. TERMINATION OF USE

  10. The User’s failure to comply with these Terms will result in the automatic termination of the User's right to access CityServe.

     

  11. INTELLECTUAL PROPERTY RIGHTS

  12. All right, title and interest (including all copyright, patent and other intellectual property rights) in CityServe remain vested in the City at all times.

     

  13. INDEMNITY AND RELEASE

  14. The User will indemnify and hold harmless the City and its officials, employees and agents from and against all losses, claims, demands, actions, causes of action, debts, accounts, payments, expenses, costs, suits, and damages (including any damages that are direct, indirect, incidental, special or consequential), including any and all claims of third parties, whether or not caused by the negligence of the City, or its officials, employees or agents, which are incurred by the City, or its officials, employees or agents and would not or could not have been incurred but for the User's use of CityServe or the User's breach of these Terms.

    The User hereby releases and forever discharges the City, its officials, employees and agents from any and all losses, claims, demands, actions, causes of action, debts, accounts, payments, expenses, costs, suits, and damages (including any damages that are direct, indirect, incidental, special or consequential), including any and all claims of third parties, that the User may have or will have against the City for any loss including economic loss, damage or injury, suffered by the User or any third parties arising out of the User’s use of the CityServe, whether or not caused by the negligence of the City, or its officials, employees or agents.

     

  15. JURISDICTION AND SEVERABILITY

  16. These Terms are governed by the laws of British Columbia. If any part of these Terms is found to be unenforceable, then that part will be severed and the remainder of these Terms will continue to be enforceable.
